Responsible Use of AI in HR: Balancing Compliance and Fairness

At Data & Business Legal, with a Certified AI Compliance Officer (CAICO®) in-house, I guide organizations in the responsible implementation of AI in HR.

Under Article 4 of the EU AI Act, organizations are required to ensure that their employees possess sufficient AI competence, while the GDPR mandates careful handling of personal data.

AI tools can, for example, automatically screen résumés and select candidates, but without the right safeguards, unintended bias can easily arise. A well-known case is Amazon’s recruitment AI, which discriminated against female applicants because it was trained on historical, gender-biased data.

However, AI can also bring positive impact: tools that make job postings more inclusive by recommending gender-neutral language, or algorithms that identify patterns in pay disparities, helping promote fair career development.

Transparency and human oversight are always essential. Every AI-based recommendation in recruitment or evaluation should undergo a human “final check” before any decision is made. This ensures both legal compliance and a human-centred HR approach.

With expertise in AI compliance and privacy regulation, I translate complex requirements into clear, practical processes, enabling HR teams to work with AI in line with legal standards.

How is your HR department currently approaching AI, and what questions are arising in your organization? Feel free to share your thoughts in the comments or get in touch.
